Khantractor Terms of Service

Effective date: August 12, 2026

These Terms of Service (the “Terms”) govern your access to and use of Khantractor’s website at www.khantractor.com, your Khantractor account, and any Khantractor courses, lessons, videos, quizzes, practice exams, drawings, downloads, and related services (collectively, the “Services”). In these Terms, “Khantractor,” “we,” “us,” and “our” refer to Khantractor.

By creating an account, clicking to accept these Terms, purchasing a product, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not create an account, make a purchase, or use the Services.

1. Eligibility and accounts

You must be at least 18 years old, or the age of legal majority where you live, to create an account or purchase or use the Services.

You must provide accurate, current information and keep your login credentials confidential. Each purchase and account is for one individual unless we agree otherwise in writing. You may not share, sell, transfer, or allow another person to use your account or course access. Notify us promptly at [email protected] if you suspect unauthorized account use.

2. Courses and access

Khantractor provides self-paced educational and exam-preparation materials. Course features, curriculum, price, and any stated access period are described on the applicable product or checkout page at the time of purchase.

Unless a product page or written offer states a specific access period, access continues while Khantractor offers the applicable course on its current platform and your account remains in good standing. This does not promise permanent or “lifetime” access. We may update, replace, reorganize, or remove course material to reflect code changes, exam changes, licensing restrictions, technical needs, or improvements. If we permanently discontinue a paid course and the change materially shortens an expressly stated access period, we will provide a reasonable substitute, continued access where practicable, or an appropriate refund as required by law.

You are responsible for obtaining any code books, standards, plan sets, equipment, software, or other third-party references identified as required but not expressly included with the course.

3. Educational and professional disclaimer

The Services are for education and exam preparation only. They are not engineering, architectural, legal, safety, employment, or other professional advice and are not a substitute for applicable codes, standards, official exam bulletins, or advice from a qualified professional familiar with your situation.

We do not guarantee that you will pass an exam, obtain or maintain a certification or license, qualify for employment, receive a promotion, or achieve any particular income or career result. Exam content, eligibility rules, reference materials, codes, and standards may change. You are responsible for confirming current requirements with the organization that administers your exam or credential.

Unless expressly stated otherwise, Khantractor is independent and is not sponsored, endorsed, approved by, or affiliated with the International Code Council (ICC), American Concrete Institute (ACI), American Welding Society (AWS), The Masonry Society (TMS), or any other certification, testing, standards, or code organization. Third-party names and marks belong to their respective owners.

4. Purchases, prices, and taxes

Prices and available products may change prospectively at any time. The price displayed at checkout when you submit an order is the price that applies to that order, subject to correction of an obvious error. You authorize Khantractor and its payment processors to charge the payment method you provide for the displayed price, applicable taxes, and any clearly disclosed fees.

You must provide complete and accurate billing information and use a payment method you are authorized to use. We may refuse, cancel, or refund an order reasonably suspected to be unauthorized, fraudulent, duplicative, or made in violation of these Terms. Payments are processed by Thinkific Payments and its payment-processing partners; Khantractor does not receive your complete payment-card number.

Promotional codes have no cash value, may be subject to stated conditions, and generally cannot be combined or applied retroactively.

5. Refund Policy

We want you to have a fair opportunity to evaluate a course while also protecting our digital course materials from substantial use followed by a return.

Standard course purchases

You may request a refund for your first purchase of an individual course if all of the following are true:

1. You email [email protected] within 7 calendar days after the purchase date;

2. Your Thinkific course progress shows that you have completed or accessed no more than 20% of the course; and

3. You have not earned or downloaded a completion certificate for that course.

Your request must include the purchaser’s name, account email address, course name, order number if available, and a short description of the reason for the request. We may ask for information reasonably necessary to locate and verify the purchase.

Requests that do not qualify

Except where required by law or expressly stated in a product-specific written offer, we do not provide a refund when:

- the request is submitted more than 7 calendar days after purchase;

- more than 20% of the course has been completed or accessed;

- a completion certificate has been earned or downloaded;

- the same customer previously received a refund for the same course;

- access was suspended or terminated because of account sharing, copying, infringement, fraud, or another material violation of these Terms; or

- the request is based only on an exam result, certification decision, employment outcome, or change of mind after the eligibility period.

Duplicate charges, unauthorized purchases, and technical problems

The limitations above do not prevent correction of a confirmed duplicate charge or unauthorized transaction, and they do not limit any non-waivable rights provided by law. Report a billing problem promptly to [email protected].

If a technical problem on our side prevents you from accessing a paid course, contact us and give us a reasonable opportunity to restore access. If we cannot restore access within a reasonable time, we will provide an appropriate remedy, which may include extended access, a substitute, or a full or partial refund as required by the circumstances and applicable law.

How refunds are issued

Approved refunds are returned to the original payment method and include refundable taxes as required by law. We generally submit an approved refund within 5 business days. Your bank or card issuer may require additional time to post the credit. Course access may end when a refund is approved.

Please contact us before initiating a payment dispute so we have an opportunity to investigate and resolve the issue. Nothing in these Terms waives any right you may have under applicable law or card-network rules.

Mandatory consumer rights

This Refund Policy does not limit any cancellation, withdrawal, refund, or other consumer right that cannot legally be waived. If the law where you live gives you a more favorable mandatory right, that right applies.

6. License and intellectual property

The Services and all course content are owned by Khantractor or its licensors and are protected by copyright, trademark, and other laws. Subject to these Terms and payment of applicable fees, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the purchased course for your own education during the applicable access period.

You may download or print materials only when the course provides a download or print option, and only for your personal, noncommercial study. You may not copy, record, reproduce, publish, upload, transmit, distribute, sell, sublicense, publicly display, create derivative works from, scrape, or commercially exploit any portion of the Services. You may not share course videos, quizzes, practice questions, plan sets, annotated drawings, downloads, login credentials, or substantially similar reproductions with another person or use them to create or train a competing product or service.

No right is granted except as expressly stated in these Terms. “Khantractor” and related branding are Khantractor marks and may not be used without prior written permission.

7. Acceptable use

You may not:

- use the Services unlawfully or to violate another person’s rights;

- bypass access, payment, download, copy-protection, or security controls;

- probe, scan, disrupt, overload, or introduce malicious code into the website or platform;

- use bots, scraping tools, or automated means to access or extract content except as permitted by law and not capable of waiver by contract;

- impersonate another person or provide false or misleading account or billing information;

- post or transmit content that is infringing, unlawful, threatening, harassing, defamatory, or malicious; or

- help another person do any of the above.

8. User communications and feedback

If you send us questions, reviews, suggestions, or other feedback, you retain ownership of your original content. You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display feedback or reviews for operating, improving, and promoting the Services, unless you tell us in writing that the communication is confidential or applicable law requires otherwise. We will not publish your full name, image, or other identifying testimonial without permission where permission is required by law.

You represent that content you submit is accurate to the best of your knowledge and does not violate another person’s rights.

9. Third-party platforms, references, and links

The Services are hosted on Thinkific and may rely on third-party payment, video, analytics, communications, security, and content providers. Third-party services and websites are governed by their own terms and privacy practices. We are not responsible for third-party products, exam administrators, code publishers, external links, or service interruptions outside our reasonable control.

10. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you have materially violated these Terms, created security or legal risk, failed to pay an amount due, or engaged in fraud, account sharing, or infringement. When reasonable, we will provide notice and an opportunity to address the issue before termination, but we may act immediately to protect users, content, or systems.

Termination does not eliminate payment obligations or provisions that by their nature should survive, including intellectual-property, disclaimer, limitation-of-liability, and dispute provisions.

11. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Khantractor disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, completely current, or suitable for a particular exam, project, jurisdiction, or purpose.

Some jurisdictions do not allow certain warranty exclusions, so some of the exclusions above may not apply to you. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by law, Khantractor and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; loss of profits, income, opportunity, goodwill, or data; exam or certification results; or decisions made in reliance on course content.

To the fullest extent permitted by law, Khantractor’s total liability arising out of the Services or these Terms will not exceed the greater of (a) the amount you paid Khantractor for the product giving rise to the claim during the 12 months before the event giving rise to liability or (b) US $100.

These limitations do not apply to liability that cannot be limited by law, including liability for fraud, willful misconduct, or personal injury caused by negligence where exclusion is prohibited.

13. Indemnity

To the extent permitted by law, you agree to reimburse Khantractor for reasonable losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your unlawful use of the Services, infringement of another person’s rights, or material violation of these Terms. This section does not require you to indemnify Khantractor for Khantractor’s own unlawful conduct, negligence, or breach of these Terms.

14. Changes to the Services or these Terms

We may update these Terms prospectively. The effective date above shows when they were last revised. If a change materially affects existing paid access or your legal rights, we will provide reasonable notice through the website, your account, or email when required by law. Changes do not retroactively alter an already-submitted refund request or another accrued right. Your continued use after updated Terms take effect constitutes acceptance where permitted by law.

15. Governing law and disputes

These Terms and any dispute involving the Services are governed by the laws applicable where Khantractor maintains its principal place of business, without regard to conflict-of-law rules, except that mandatory consumer-protection laws in your place of residence continue to apply when they cannot be waived.

Before filing a claim, you and Khantractor agree to make a good-faith attempt to resolve the issue by written notice and at least 30 days of informal discussion. Send notice to [email protected]. This informal process does not prevent either party from seeking urgent injunctive relief or filing within a limitations period.

16. General terms

These Terms, the Privacy Policy, the applicable product description, and any written product-specific terms presented at checkout form the entire agreement concerning the Services. Product-specific terms control only if they expressly conflict with these Terms.

If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a merger, reorganization, sale of assets, or by operation of law, subject to applicable law. Section headings are for convenience only.
